Data Rights Outside the DFARS
Discussion of how the U.S. government and federal contractors' allocation of rights in technical data and computer software tends to focus on the rules enacted by Congress and implemented in the Defense Federal Acquisition Regulation Supplement (DFARS). This Boot Camp will shift focus away from the DFARS to other contexts in which federal law, regulations, or contract terms can and do determine those rights allocations.
This Boot Camp will review:
- Key differences between the civilian Federal Acquisition Regulation (FAR) and defense (DFARS) regimes for data rights;
- Types of agreements not subject to the FAR or DFARS regimes;
- Recent developments in caselaw involving data rights; and
- Practical guidance for managing IP in these non-DFARS environments.
