Megan Brown Discusses Changing Enforcement Dynamics Across Federal Government with Inside EPA

Megan L. Brown, co-chair of the Privacy, Cyber & Data Governance Practice, was quoted by Inside EPA in the article, "Citing Loper Bright, Industry Seeks To ID More EPA Actions For Rollback," regarding how the U.S. Supreme Court's ruling in Loper Bright is changing enforcement dynamics across the federal government. "When an agency is pursuing investigations and enforcement work using some kind of novel theory, there's a question of 'Okay, if we really wanted to fight you on this, we think we could win, because you do not have the right interpretation of the statute,'" Brown said. "I have seen that calibrating some of the power dynamics in those investigations."
