Jonathan counsels and represents government contractors, subcontractors, and non-traditional contractors on a broad range of legal issues, including bid protests, contract claims and disputes, other transaction agreements (OTAs), and compliance issues. Jonathan also helps government contractors navigate government and internal investigations and has experience advising and representing clients on various matters involving the civil and criminal False Claims Act (FCA), including analyzing, investigating, and responding to Civil Investigative Demands (CID).
Experience
Representative Matters
- Regularly represents clients in bid protests and interventions at the Government Accountability Office (GAO) and the United States Court of Federal Claims (COFC).
- Successfully represented a government contractor at COFC challenging the award of a $254 million OTA for space vehicles.
- Successfully represented a small business government contractor in challenging GSA’s award of a $221 million contract for advisory and assistance services.
- Represented and advised a government contractor in connection with a dual criminal and civil FCA investigation and successfully negotiated settlement and no indictment.
- Represented and advised a government contractor in connection with a civil False Claims Act investigation involving small business subcontracting. Successfully convinced the Department of Justice to decline to intervene in the Qui Tam action which resulted in a voluntary dismissal.
- Represented and advised a government contractor in disclosing out-of-scope ordering.
- Represented and advised a government contractor in investigating and responding to concerns about government billing practices.
- Advised government contractor on potential request for equitable adjustment based on claims for government disruption and delay.
